These Terms of Service apply when you use the freshanddaily online store or order drinkware, hydration products, coolers, filtration items, and practical outdoor equipment. Using the site or submitting an order means you accept these terms and the policies linked in the footer. Mandatory consumer rights remain fully available and are not waived by these terms.

Eligibility and acceptable use

You must give accurate information, be legally able to enter the transaction or act with a parent or guardian, and use the site only for lawful purposes. Do not defeat security, introduce malicious code, misuse another person's information, disrupt the store, or infringe third-party rights.

Products and availability

We aim to present descriptions, dimensions, ingredients or materials, compatibility, quantities, colors, and other item facts accurately. Displays and manufacturer details can vary. Availability may change before checkout is completed. Follow all product-page directions, warnings, age guidance, pet guidance, care instructions, and suitability information that apply to the item.

Orders, USD prices, and taxes

An order submission is an offer to buy. We may reject or cancel it for unavailable stock, payment failure, suspected fraud, pricing error, legal restriction, or an address we cannot serve; amounts collected for a cancelled order are refunded. Prices and checkout charges are shown in United States dollars (USD). Taxes are collected when applicable law requires them.

Payment

Only methods shown in the live checkout are available. The Payment Policy lists supported card networks and further details. You confirm that you are authorized to use the selected method. A payment authorization does not mean the order has shipped.

Shipping, returns, and refunds

We serve United States addresses only. Processing, free shipping, transit estimates, tracking, pre-shipment cancellation, the 30-day return window, exchanges, prepaid labels, exceptions, and refund timing are controlled by the Shipping Policy and Refund Policy, which are incorporated into these terms.

Store content and trademarks

Original store text, graphics, organization, and design are owned by or licensed to freshanddaily and protected by applicable law. Product names, images, and marks may belong to their respective owners. Personal access to the site does not transfer intellectual-property rights.

Third-party services

Shopify, checkout, payments, analytics, carriers, and other functions may be provided by third parties with their own terms and privacy practices. An external link is offered for convenience and does not make us responsible for an unaffiliated site's content or availability.

Disclaimers and liability

To the extent law permits, the site is provided on an “as available” basis and implied warranties or liability for indirect, special, incidental, or consequential loss are limited only where lawful. Nothing here excludes a liability or remedy that cannot legally be excluded, including mandatory consumer rights for defective, unsafe, or misdescribed goods.

Applicable law, changes, and severability

Applicable United States law and any mandatory consumer law at the customer's location govern. Contact us first so we can try to resolve a concern. We may change these terms prospectively by posting a new effective date. If one part is unenforceable, the remaining provisions continue to the maximum extent allowed.
